The Contract

The relationship between Simon Paul and the client will be that of ‘independent contractor’, which means that we are not the client’s employee, worker, agent or partner, and we will not give the impression that we are. Our time will therefore be limited to the project at hand, including any consultation time warranted by the project.

Our Pricing Terms

Our current copywriting fees are dependent on the project, either as an agreed package, hourly, day or other rate. Before each project, we will provide a quote so that you know exactly how much the work will cost. Any changes to the original brief initiated by the client may require us to adjust the cost. Any additional work requested that isn’t covered in the original brief will be quoted separately and added to the original invoice.

The Copywriting Brief

The Brief will be supplied by the client and must clearly outline the project requirements. We suggest that you download, complete and return my briefing form to ensure that We have all the necessary requirements beforehand.

Commencement of Work

Before your project is undertaken, we require a confirmation email, stating:

– You are authorised to commission the project

– You agree to our fees

Timescale and Deadlines

We will make every effort to ensure your project is delivered on time. In the unlikely event that we cannot meet the agreed deadline, we will let you know as soon as possible. We will not be held liable for any loss or damages to any party as a result of missing a deadline.

Payment Terms for Direct Clients and Agencies

For new clients, we require a 25% deposit of the total fee before commencing work. For larger projects, we will arrange staggered payments, to be paid when we meet project milestones. All invoices are sent electronically, unless agreed otherwise and are payable within 30 days of receipt.

We accept payment PayPal or direct bank transfer, but unfortunately we do not accept cheques.

We understand that with agencies, copywriting usually forms part of a bigger project and can often take several months to complete. When working with agencies, we require payment to be made within 7 days of sending the invoice, whether the client has signed off on the project or not.

Cancellation

Cancellation of my services must be communicated in writing at least 7 days before a deadline is due otherwise the full amount remains payable. Deposits will only be returned in the event of hardship.

Late Payment Terms

We understand and will exercise our statutory right to interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms.

International Payment Fees

International clients are expected to cover any additional currency conversion charges.

Intellectual Property Rights

Upon completion of the project all copyrights are transferred to the client only after we have received payment in full. We reserve the right to use any extracts of our work for our portfolio.

Whilst we make every effort not to breach any copyright, you agree to indemnify Simon Paul against action that may arise as a result of using my services.

Errors and Omissions

We make every effort to ensure that the project is proofread, grammatically accurate and factually referenced where applicable. However, we cannot guarantee that every project is completely free from typographical, grammatical or factual errors.

Indemnity

By using our services, you agree to indemnify us against:

– Any claim, including that of a third party, for compensation or damages resulting from the use of our written material or from unsought permissions to use my material.

– Although every piece of written content we produce is original, the client accepts full responsibility for checking the authenticity of the project, including research materials and citations supplied and indemnify me of any compensation for loss or damages.
